Our Cost Services Agreement

“No Win – No Fee” Policy
You only pay if you succeed. Success is defined as receiving any verdict, settlement or cost award in your favour.

Our hourly charge rate  - $445.00 per hour (plus GST)
The law in Australia does not allow us to charge a percentage of the settlement. We are only allowed to charge by the hour. However, as a guide on average, we will charge you in the range of 15% - 25% of your compensation award for our fees. The larger the financial result, the smaller the percentage we charge.

If your award is greater than $500,000.00 we reserve the right to charge $590.00 per hour plus GST.

This legal firm has:-

1. Run in excess of 13,000 claims;
2. Won compensation for clients approaching $1 billion dollars.
3. A reputation as being aggressive, and is offered the best financial settlements for its clients.

By accepting our Costs Agreement you are contracting out of the standard rates charged under various government statutes for basic legal services.

Termination of Agreement
If you:-

1. Fail to accept a reasonable offer of settlement which we have recommended; or
2. If you terminate the agreement at any time without a reasonable explanation or engage another law firm to take over the matter; or
3. Knowingly mislead us or give false and unreliable instructions;

Disbursements we may incur in the running of your file
Disbursements are additional expenses and include fees paid for accountants, barristers, medical reports, engineers and accident reconstruction expert reports, various court filing fees, photocopying and facsimile transmissions (charged at $1.10 per page), where necessary.

Following the successful completion of your matter you will be charged the following:-

1. File storage charges $125.00;
2. File retrieval charges $95.00;
3. A $440.00 administration fee to cover the opening of your file;
4. 12% per annum on any disbursements paid on your behalf.

Where you may be required to pay some legal costs to the other side – Most unlikely:
It is possible that if you lost your case the Defendant on the other side can sue you for their legal costs. Please do not be alarmed as in the last three decades of practice we can count on our fingers the number of cases where our client’s have been sued. We have run 13,000 cases and, it is highly likely that if the case was very weak or was going to be lost we would pull out of it prior to the Hearing without costs orders made against you personally. You simply need to be aware that it could possibly happen but it is very very rare!!! Our rate is less than 0.3% guaranteed.

Acceptance of the Cost Agreement
It is a condition of your continuing with the claim that:-

1. We are entitled to be in receipt of the settlement proceeds and;
2. We will be entitled to deduct our reasonable costs and disbursements at the conclusion of this matter upon rendering of an account setting out the costs and disbursements in running your claim.
3. By you returning the signed attached authority you are accepting the terms of our cost agreement.
4. Our “No Win No Fee Agreement” may be forfeited if you leave our firm and instruct another law firm without good reason.
